Terms of Service

These Terms of Service govern your use of Jason Holt Photography services. By booking a session or using our website, you agree to these terms.

1. Photography Services

Jason Holt Photography offers portrait, wedding, engagement, event, and family photography services as described on our website. The specific details of your session will be confirmed upon booking. All prices include the statutory German VAT (currently 19%).

2. Booking and Payment

All bookings are confirmed upon receipt of a deposit, typically 50% of the total session fee. The remaining balance is due on or before the day of the photography session. Payments are non-refundable but may be transferable to another date with sufficient notice.

3. Right of Withdrawal and Cancellation Policy

Right of Withdrawal: As a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

Effects of Withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

Exception to Withdrawal Right: The right of withdrawal expires prematurely for contracts for services if the service has been fully provided and you expressly consented to us beginning the provision of service, with the knowledge that you would lose your right of withdrawal once the contract had been fully performed.

For Photography Sessions: Cancellations made more than 14 days before the scheduled session may receive a full refund. Cancellations with less than 14 days' notice are subject to our standard cancellation policy below.

Standard Cancellation Policy: For cancellations less than 14 days before the session, the deposit is non-refundable. Rescheduling requests should be made at least 7 days in advance. Rescheduling with less notice may incur additional fees.

4. Image Delivery

Digital images will be delivered within 2-4 weeks of your session via an online gallery. The exact number of images delivered depends on your package selection. Additional editing or rush delivery may incur extra charges.

5. Copyright and Image Usage

Jason Holt Photography retains copyright of all images. Clients receive a personal use license allowing them to print, share, and use images for personal purposes. Commercial use requires separate licensing.

By booking with Jason Holt Photography, you grant permission to use images from your session for portfolio, social media, and marketing purposes unless explicitly agreed otherwise in writing.

6. Session Conduct

Jason Holt Photography reserves the right to terminate coverage and leave the location if confronted with inappropriate, threatening, hostile, or offensive behavior from anyone at the session.

7. Creative License

Jason Holt Photography reserves creative license regarding poses, locations, and photographic style. Specific requests will be considered but cannot be guaranteed.

8. Limitation of Liability

In the unlikely event of technical failure, injury, illness, or other circumstances beyond control, liability is limited to a refund of payments made. Jason Holt Photography is not responsible for compromised photography due to interference from other persons or environmental conditions.

9. Force Majeure

Neither party shall be liable for failure to perform when prevented by circumstances beyond reasonable control, including but not limited to acts of God, fire, natural disaster, pandemic, or government restrictions.

10. Changes to Terms

Jason Holt Photography reserves the right to modify these terms at any time. Changes will be posted on the website and will be effective immediately upon posting.

11. Governing Law

These terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Frankfurt.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) which can be accessed at https://ec.europa.eu/consumers/odr. We are willing to participate in an extra-judicial dispute settlement through a consumer dispute resolution body.
